Terms and Conditions of Sale

Article 1, Purpose

These terms and conditions of sale apply to every order placed on the bijoux-obsidienne.fr website, between Bijoux Obsidienne (hereafter "the Seller") and any person making a purchase (hereafter "the Customer"). Placing an order implies full and unreserved acceptance of these terms.

Article 2, The Seller

The website is published by Camille, a sole trader (entrepreneur individuel) registered in France, whose full details appear in the legal notice. Contact: contact@bijoux-obsidienne.fr.

Article 3, Products

The products offered are handmade pieces of jewellery, in obsidian and natural stones. As every piece is made by hand, slight variations in shade, shape or sheen may occur: they are part of what makes each creation unique and are not faults. Photographs are as faithful as possible but are not absolutely contractual. Products are offered subject to stock and to the pieces available.

Article 4, Prices

Prices are shown in pounds sterling, VAT not applicable under Article 293 B of the French General Tax Code, excluding delivery costs. Any delivery costs are stated before the order is confirmed and are added to the price of the products. Depending on the value of your order, import VAT or customs duty may be payable on arrival in the United Kingdom; see the Delivery & returns page. The Seller reserves the right to change prices at any time; products are invoiced at the price in force when the order is placed.

Article 5, Orders

The Customer selects the products, checks the details of the order, then confirms it having accepted these terms. The sale is considered firm once the order has been confirmed by email and payment has been received. The Seller reserves the right to refuse or cancel any order that is abnormal or made in bad faith.

Article 6, Payment

Payment is made online by debit or credit card, or PayPal (or in three instalments, depending on the methods offered), through a secure payment provider. The order is processed once payment has been confirmed. The products remain the property of the Seller until the price has been paid in full.

Article 7, Delivery

Delivery times, destinations and costs are set out on the Delivery & returns page. Timescales are given as estimates. The Customer is asked to check the condition of the parcel on arrival and to report anything wrong as soon as possible.

Article 8, Right to cancel

The Customer has 14 days from receiving the order to exercise their right to cancel, without having to give a reason. To do so, they inform the Seller of their decision by an unambiguous statement (by email, or using the model form at the end of this page). This 14-day period applies both under the French Consumer Code and, for customers resident in the United Kingdom, under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.

Exceptions

The right to cancel does not apply to goods made to measure or clearly personalised, nor, for reasons of hygiene, to items unsealed after delivery (where applicable, e.g. earrings).

Article 9, Returns & refunds

The product must be returned unworn, in its original condition and with its gift box. Return postage is at the Customer's expense, except in the case of an error or a faulty product. The refund is made within 14 days of the product being recovered (or of proof of its dispatch), to the payment method used for the order. The practical details are on the Delivery & returns page.

Article 10, Legal guarantees

Independently of any commercial guarantee, all products benefit from:

• the legal guarantee of conformity (Articles L. 217-3 et seq. of the French Consumer Code), which applies for 2 years from delivery of the goods;
• the guarantee against hidden defects (Articles 1641 et seq. of the French Civil Code).

Customers resident in the United Kingdom also keep the rights afforded to them by the Consumer Rights Act 2015, under which goods must be of satisfactory quality, fit for purpose and as described. Nothing in these terms affects those statutory rights.

Where a product is not as described or is faulty, the Customer may contact me at contact@bijoux-obsidienne.fr; a solution (repair, replacement or refund) will be sought within the framework provided by law.

Article 11, Liability & force majeure

The Seller cannot be held responsible for inappropriate use of the products, nor for any failure to perform due to force majeure or to circumstances beyond the Seller's control. Jewellery is delicate: care instructions are provided to help preserve its shine.

Article 12, Intellectual property

All elements of the website (text, photographs, logo, creations) are protected by copyright and remain the property of the Seller. Any reproduction or use without written permission is prohibited.

Article 13, Personal data

The data collected is processed in accordance with the GDPR. The Customer has the right to access, rectify and erase their data. To find out more, please read the privacy policy.

Article 14, Mediation & disputes

In the event of a dispute, the Customer is invited to contact the Seller so that an amicable solution can be found. Failing that, under Articles L. 612-1 et seq. of the French Consumer Code, the Customer may refer the matter free of charge to the consumer mediator: Mediation Vivons Mieux Ensemble (see the legal notice).

Article 15, Governing law and language

These terms are governed by French law. They were drawn up in French, and this English text is a translation provided for convenience: in the event of any discrepancy, the French version prevails. If you are a consumer, this choice of law does not deprive you of the protection afforded by the mandatory rules of the country in which you are habitually resident. Should any clause be declared void, the remaining provisions continue to apply. The applicable version is the one in force on the date of the order.
