Terms and Conditions of Sale
These terms govern sales made through bijoux-obsidienne.fr to customers in Australia. By placing an order, you accept them.

1, Purpose
These terms and conditions of sale apply to every order placed on bijoux-obsidienne.fr between Bijoux Obsidienne (the "Seller") and any person making a purchase (the "Customer"). Placing an order means accepting these terms in full.
2, The Seller
The site is run by Camille, a sole trader based in France, whose full details appear in the legal notice. Contact: contact@bijoux-obsidienne.fr.
3, Products
The products offered are handmade pieces of jewellery in obsidian and natural stone. Because every piece is made by hand, slight variations in tone, shape or the way light catches the stone can occur: they are part of what makes each creation unique and are not a fault. Photographs are as faithful as I can make them but are not absolutely contractual. Products are offered subject to available stock and available pieces.
Important, my jewellery consists of decorative and wellbeing objects. The properties attributed to stones in crystal healing come from tradition and belief; they are not a therapeutic claim, and they are in no way a substitute for medical advice or treatment.
4, Prices
Prices are shown in Australian dollars (AUD), excluding delivery costs. The Seller is established in France and is not currently registered for Australian GST, so no GST is charged on these sales. Any delivery costs are stated before you confirm your order and are added to the price of the products.
The Seller may change prices at any time; products are invoiced at the price in force at the moment the order is placed.
5, Orders
The Customer selects the products, checks the details of the order, then confirms it having accepted these terms. The sale is firm once the order is confirmed by email and payment has been received. The Seller may refuse or cancel any order that appears abnormal or made in bad faith.
6, Payment
Payment is made online by card or PayPal (or in instalments, depending on the methods offered), through a secure payment provider. The order is processed once payment is confirmed. Products remain the property of the Seller until the price has been paid in full.
7, Delivery
Delivery times, destinations and costs are set out on the Delivery & returns page. Orders are made and posted from France, so transit times are those of an international parcel and are given as a guide. The Customer is asked to check the condition of the parcel on arrival and to report anything wrong as soon as possible.
8, Change of mind returns
Australia has no statutory cooling-off period for online purchases. What follows is therefore my own commercial promise, offered in addition to, and never instead of, your rights under the Australian Consumer Law set out in clause 10.
If you simply change your mind, you have 14 days from the day your order arrives to let me know, with no need to explain. Tell me by email, or use the return request form at the end of this page.
Exclusions
This change of mind promise does not apply to pieces made to measure or clearly personalised, nor, for hygiene reasons, to items unsealed after delivery (for example earrings).
To be clear, these exclusions apply only to change of mind. They do not affect your consumer guarantees: if a piece is faulty, not as described or not fit for purpose, clause 10 applies regardless of what it is or whether it was personalised.
9, Returns & refunds
For a change of mind return, the product must come back unworn, in its original condition and with its gift box. Return postage is at the Customer's expense for a change of mind, and at the Seller's expense where the fault was mine or the piece is faulty.
The refund is made within 14 days of the product being received back (or of proof of its despatch), to the payment method used for the order. The practical steps are on the Delivery & returns page.
10, Your rights under the Australian Consumer Law
This clause sets out rights you have by law. Nothing in these terms excludes, restricts or modifies them.
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage.
You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
In practice this means every piece must be of acceptable quality, match its description and the photographs shown, and be fit for the purpose it was sold for. These guarantees have no fixed expiry date: they last for the period a reasonable person would expect, given the price paid and the nature of the piece.
If something is wrong, write to me at contact@bijoux-obsidienne.fr with your order number and a photograph. Where a consumer guarantee applies, I cover the return postage and we sort out a repair, replacement or refund as the law provides.
11, Liability & events beyond control
Subject always to clause 10, the Seller is not liable for inappropriate use of the products, nor for failure to perform caused by an event beyond the Seller's reasonable control. Jewellery is delicate: care instructions are provided so you can keep each piece at its best.
12, Intellectual property
Everything on this site (text, photographs, logo, designs) is protected by copyright and remains the property of the Seller. Reproduction or use without written permission is prohibited.
13, Personal information
Personal information is handled in line with the Australian Privacy Principles and, where it applies, the European GDPR. You may ask to access, correct or delete your information at any time. For more, see the privacy policy.
14, Complaints & disputes
If something goes wrong, please contact me first so we can sort it out directly, that is almost always the fastest route.
If we can't resolve it between us, you can seek help from the Australian Competition and Consumer Commission (ACCC) or from the consumer protection or fair trading office in your state or territory, which handles consumer complaints free of charge.
15, Governing law
These terms are governed by French law, the Seller being established in France, and are written in English for Australian customers.
This does not reduce your rights. Where you buy as a consumer in Australia, the Australian Consumer Law applies to this sale, and nothing in these terms, including this clause, excludes, restricts or modifies any right or remedy under it that cannot lawfully be excluded.
If any provision is held to be invalid, the remaining provisions continue to apply. The applicable version is the one in force on the date of the order.
